If you have sufficient business presence in a jurisdiction that recognizes unregistered trademarks—and you may want to go back to one of this videos in the list where I am explaining what unregistered trademarks are and which jurisdictions recognize them—if you are well known in that jurisdiction that recognizes unregistered trademarks, you can use Uniform Domain Name Resolution Policy but the vast majority of cases, and especially those where the complainant, the trademark owner was successful, the trademark owner had a registered trademark at least in one jurisdiction. And it has to be a legitimate registration that’s linked to a real business, so you can’t just go and register your trademark, in one of those jurisdictions that allow you to quickly and easily get a trademark, even if you have no plans of doing business there. It has to be a legitimate registration. So, if somebody registered a domain name that’s confusingly similar with your trademark, you can go after them with UDRP. Now, the important thing is that domain name must have been registered in bad faith. So somebody who did it, knew about your brand and they registered it either in order to sell it to you or in order to prevent you from reflecting your brand in that domain name. It is something that you need to prove. What matter is that the domain name must have been registered after you have your rights to the trademark. I will share with you a story. Trademark Factory is a good example. When I came up with a name, TRADEMARKFACTORY.COM was already taken. It wasn’t used, nobody was using it, but somebody registered that domain name and at that point, I got TRADEMARKFACTORY.CA. We were starting in Canada, most of the business at that point was coming from Canada, so we got the .CA. And I wrote to the domain name owner and said, would you be willing to let go of the .COM? And they wanted to get some ridiculous amount of money—at that point I thought it was ridiculous, because I wasn’t sure if the brand is going to stick. But next year when I realized that what I have built is a viable business with a great model that a lot of business owners not just from Canada but from around the world want to use to get their trademark registered, I realized that there is a lot of value in the brand. So I wrote to them again—and never heard back. And then I wrote again and never heard back. So what I was looking at at that point was when is the domain name going to expire. And about a month before the expiration date for the domain name registration, I started getting all those e-mails from a ton of registrars, “This domain name is just about to expire, would you be willing to do a back order and start this auction to get the domain name?” So what I did was I called my own registrar and I said, “Look, there is this domain name, TRADEMARKFACTORY.COM that’s going to become available. I want to make sure that I end up getting it.” And there is this procedure that allows you to back-order, so I did that and in order to go through the process of this back-ordering, you’re supposed to give a bid. What’s the maximum amount you are willing to pay to the registrar if there is a bidding war for the domain name. And I said, “$1,500.” And the registrar asked, “Why only $1,500? Isn’t it brand worth more?” So I responded, “Of course, it’s worth a lot more, but $1,500 is what it will cost me to take this domain name through the Uniform Domain Name Resolution Policy from anybody, anybody other than the current owner. So the only person I couldn’t go after was the guy who registered the domain name TRADEMARKFACTORY.COM before I registered my trademark, before I started having rights in my trademark. So they were the only ones I couldn’t go after, but by registering my trademark, I became the market of one for them because if they were to sell the domain name to anybody else, could use Uniform Domain Name Resolution Policy to take that domain name from a new buyer very easily. So importantly, again, remember: in order for this to work, the domain name must have been registered in bad faith. Hi Everyone, My name isReset Synchronizer’. I have been tasked to do a very specific job. Though, I look to be a very small piece of circuit, I help the whole design to get reset’ed without any violations. You can think of my job to be very similar and as critical as my brother ‘The clock’. Even I my own tree and my own network, just like my brother has. The only difference is, I am not as strict on skew, as my brother is. I am a bit flexible, which makes me even prouder and lovable by designers Let me try to show you in this video, what happens when you try to reset design without me, asynchronously My close friend (also the one who can’t stay without me, stay with me till end of this post) ‘rst_n’ looks to be very confident while asserting himself onto whole design and very successfully resets the complete design. But he creates lots of problems for the whole design, while de-asserting himself. How? Whenever he tries to de-assert himself near active edge of clock, he creates violations, doesn’t satisfy setup/hold requirements of flops, corrupts their data and creates meta-stability That’s when, these flops, came to me asking for a solution. I gave it a lot of thought, and tried to convince my friend ‘rst_n’ to allow me come and stand firmly in between him and the design. He’s my friend, and so I should be saving him, right. I mean, that’s friends are for…. So I came in between, as shown in this video Now, I have a very superior connection, with Vdd directly connecting me at my ‘D’ input and my friend ‘rst_n’ connecting with me at my ‘RST’ pin. Now, I ask my friend ‘rst_n’ to first reset me, so that I go to a ‘0’ state, and then first de-assert me, so that only I corrupt my data (which is ok for me). My connections are so strong (see the second flop rs2), that I can easily overcome my meta-stability in 2 clock cycles as shown in this video Not only that, I also take forward this ‘mst_rst_n’ signal to all flops in the design, like a tree, just like the clock, as shown in this video. Now that I look just like any reg2reg path, my other friends, flip-flops, should just check me like any other reg2reg setup and hold violation Since that now I am being treated with same dignity and respect that my brother ‘The clock’ is being treated, the violations produced due to my signal ‘mst_rst_n’ is being given a special name. You would think by now insurance companies would routinely hand the policy owner a summary statement of benefits or some type of crib sheet of contractual imperatives. And if these carriers are thinking about providing disclosure, why can’t it be in the language of the consumer? For all the disclosures, disclaimers and caveats that are published by insurance companies and even investment houses, certain contractual semantics heavily favor the institutions, not the consumer or investor. Bottom line Joe Public doesn’t have a chance unless he/she litigates through arbitration or, God forbid, take their agent or adviser to court. In recent years, a rash of fake fiduciaries, which in the end are just insurance agents, financial advisers and money professionals, may not meet the standards of a fiduciary and shouldn’t be holding themselves out as one. When the public thinks of financial fiduciaries, they list CPAs, attorneys or trust officers. Even fee based registered investment advisers make the list by offering fee only – no commission products. Now this is not to say the others couldn’t attain to a fiduciary status, but in arbitration those who hold themselves out as fiduciaries and fail the definition, are opening themselves to greater scrutiny, especially if their online bios tout an area of expertise. Legal claims could center on the marketing approach the individual or firm uses in the public domain like ‘retirement expert’ or ‘top money manager’. If things go awry for the consumer or investor, their advocates will look to the advertising and other slogans in media and online for evidence to label the actions of the financial professional as ineptness to outright fraud. That’s not even incorporating errors and omissions that seem to occur with a great degree of frequency. It’s better to promote your services with a bit of humility, rather than billboard bravado. Most financial professionals are not ready to give creditable evidence to support their advertising claims in the public domain. Dynamic and Public Auditing with Fair Arbitration for Cloud Data Abstract: Cloud users no longer physically possess their data, so how to ensure the integrity of their outsourced data becomes a challenging task. Recently proposed schemes such as “provable data possession” and “proofs of retrievability” are designed to address this problem, but they are designed to audit static archive data and therefore lack of data dynamics support. Moreover, threat models in these schemes usually assume an honest data owner and focus on detecting a dishonest cloud service provider despite the fact that clients may also misbehave. This paper proposes a public auditing scheme with data dynamics support and fairness arbitration of potential disputes. In particular, we design an index switcher to eliminate the limitation of index usage in tag computation in current schemes and achieve efficient handling of data dynamics. To address the fairness problem so that no party can misbehave without being detected, we further extend existing threat models and adopt signature exchange idea to design fair arbitration protocols, so that any possible dispute can be fairly settled. The security analysis shows our scheme is provably secure, and the performance evaluation demonstrates the overhead of data dynamics and dispute arbitration are reasonable.
