And it has to be a legitimate registration that’s linked to a real business, so you can’t just go and register your trademark, in one of those jurisdictions that allow you to quickly and easily get a trademark, even if you have no plans of doing business there. It has to be a legitimate registration. So, if somebody registered a domain name that’s confusingly similar with your trademark, you can go after them with UDRP. Now, the important thing is that domain name must have been registered in bad faith. So somebody who did it, knew about your brand and they registered it either in order to sell it to you or in order to prevent you from reflecting your brand in that domain name. It is something that you need to prove. What matter is that the domain name must have been registered after you have your rights to the trademark. I will share with you a story. Trademark Factory is a good example. When I came up with a name, TRADEMARKFACTORY.COM was already taken. It wasn’t used, nobody was using it, but somebody registered that domain name and at that point, I got TRADEMARKFACTORY.CA. We were starting in Canada, most of the business at that point was coming from Canada, so we got the .CA. And I wrote to the domain name owner and said, would you be willing to let go of the .COM? And they wanted to get some ridiculous amount of money—at that point I thought it was ridiculous, because I wasn’t sure if the brand is going to stick. But next year when I realized that what I have built is a viable business with a great model that a lot of business owners not just from Canada but from around the world want to use to get their trademark registered, I realized that there is a lot of value in the brand. So I wrote to them again—and never heard back. And then I wrote again and never heard back. So what I was looking at at that point was when is the domain name going to expire. And about a month before the expiration date for the domain name registration, I started getting all those e-mails from a ton of registrars, “This domain name is just about to expire, would you be willing to do a back order and start this auction to get the domain name?” So what I did was I called my own registrar and I said, “Look, there is this domain name, TRADEMARKFACTORY.COM that’s going to become available. I want to make sure that I end up getting it.” And there is this procedure that allows you to back-order, so I did that and in order to go through the process of this back-ordering, you’re supposed to give a bid. What’s the maximum amount you are willing to pay to the registrar if there is a bidding war for the domain name. And I said, “$1,500.” And the registrar asked, “Why only $1,500? Hi Everyone, My name isReset Synchronizer’. I have been tasked to do a very specific job. Though, I look to be a very small piece of circuit, I help the whole design to get reset’ed without any violations. You can think of my job to be very similar and as critical as my brother ‘The clock’. Even I my own tree and my own network, just like my brother has. The only difference is, I am not as strict on skew, as my brother is. I am a bit flexible, which makes me even prouder and lovable by designers Let me try to show you in this video, what happens when you try to reset design without me, asynchronously My close friend (also the one who can’t stay without me, stay with me till end of this post) ‘rst_n’ looks to be very confident while asserting himself onto whole design and very successfully resets the complete design. But he creates lots of problems for the whole design, while de-asserting himself. How? Whenever he tries to de-assert himself near active edge of clock, he creates violations, doesn’t satisfy setup/hold requirements of flops, corrupts their data and creates meta-stability That’s when, these flops, came to me asking for a solution. I gave it a lot of thought, and tried to convince my friend ‘rst_n’ to allow me come and stand firmly in between him and the design. He’s my friend, and so I should be saving him, right. I mean, that’s friends are for…. So I came in between, as shown in this video Now, I have a very superior connection, with Vdd directly connecting me at my ‘D’ input and my friend ‘rst_n’ connecting with me at my ‘RST’ pin. Now, I ask my friend ‘rst_n’ to first reset me, so that I go to a ‘0’ state, and then first de-assert me, so that only I corrupt my data (which is ok for me). My connections are so strong (see the second flop rs2), that I can easily overcome my meta-stability in 2 clock cycles as shown in this video Not only that, I also take forward this ‘mst_rst_n’ signal to all flops in the design, like a tree, just like the clock, as shown in this video. Now that I look just like any reg2reg path, my other friends, flip-flops, should just check me like any other reg2reg setup and hold violation Since that now I am being treated with same dignity and respect that my brother ‘The clock’ is being treated, the violations produced due to my signal ‘mst_rst_n’ is being given a special name. Can you imagine my shock when I opened up an email telling me our website domain name (YOUTUBE.COM) is being taken over by GOOGLE and their video site - YOUTUBE? Here is more or less what we were told: NOTICE: Effective August 5th, 2009 Google (owner of YouTube.com) will take over your domain name: YOUTUBEISLAM.COM. Although we have purchased the name "YOUTUBEISLAM.COM" and have renewed for several years through GODADDY.COM it seems GOOGLE has enough influence to just simply take our domain name from us - and by the way, we have even paid for it all the way through to next year. First, their lawyers contacted us saying they were going to take our domain because we copied their logo. We didn't even come close to their logo, look for yourself: http://www.YOUTUBEISLAM.com/images/lo... They next came up with saying our name was too similar to their name. We changed the name and the layout to read: Yo Utu Beis Lam.com and we even registered that as a trade name. We changed the logo and the images to reflect the new name. They said they went into "arbitration" (of course we were not invited to that meeting) and then our registrar (GODADDY.COM) notified us they are "transferring" our domain name over to GOOGLE. We have always maintained the highest of standards on our site. We never allowed any videos with inappropriate material. We did not allow videos that insulted or put down other religions. No dating or suggestive materials. No bad language. Only topics fit for all the family. We paid for the bandwidth from our own pockets to make sure everything was always as it should be without having people click and wind up on websites attacking beliefs or making fun of believers and certainly nothing to hurt people\'s feelings. Above all, we did not put up any ads (especially not GOOGLE ADS) on our site. (Could this be why they want it so bad?) Or is it just so they can advertise their thousands of customers who would be happy to introduce thousands of paying advertisers to ways of entering into the homes of trusting Muslims who will think the website still belongs to Yusuf Estes and his dawah team? Maybe they just don't like Islam? Or possibily they don't like seeing so many new people entering Islam from our work? Why does GOOGLE - a company who bought YOUTUBE for billions of dollars - want to take away our little website? Good question, think you know the answer. But do we have to let them do this without at least telling others about the unjust way of dealing of these people? Are we just going to sit there and do nothing, while they destroy our work, our efforts, our viewers trust and above all - destroy the chance for many people to know the truth about real Islam in simple English language. We don't have to. We can make a difference, maybe even stop these cowards. Let's join together, all around the world and make a difference.
